Forgiven But Access Denied: Rebuilding The Marital Relationship After Incarceration

Abstract

Incarceration fractures intimate partnerships with a force that few other life events can match. The removal of one partner from the shared domestic space, the imposition of supervised communication, the financial devastation of legal costs and single-income households, the social stigma that attaches to the families of the incarcerated, and the profound relational distance generated by years of separation together constitute a marital trauma of extraordinary intensity. Yet when the incarcerated partner is released, a further and often overlooked paradox confronts couples attempting reconciliation: even when the non-incarcerated spouse has extended genuine forgiveness, and even when the released partner has made sincere efforts at rehabilitation, systemic and structural barriers — parole conditions, employment restrictions, housing exclusion zones, sex offender registries,
